1) Who We Are

Save & Build™ operates under Fathom Realty in Texas. We provide a virtual-first buyer guidance model focused on new construction, including our Buyer Credit at Closing program (subject to eligibility and builder/broker rules).

2) Not Legal/Financial Advice

Content is for general information. We do not provide legal, tax, or financial advice. Consult appropriate professionals.

3) Eligibility & Your Responsibilities

You must provide accurate information and use the Services for lawful purposes. You’re responsible for maintaining the confidentiality of any accounts and promptly notifying us of suspected misuse.

4) Scheduling, Communications, and Disclosures

By submitting forms or booking, you authorize us to contact you by email/SMS regarding your inquiry, appointment, and required disclosures (e.g., IABS/CPN).

You acknowledge receipt of required TREC disclosures when presented and agree to initial/sign where applicable before substantive discussions.

5) Buyer Credit at Closing

Any referenced Buyer Credit at Closing is subject to: Texas law, TREC, MLS, and Fathom Realty policies; builder/broker participation and cooperation; final contract terms and lender approval (credits may affect loan terms or require lender consent); your signed Buyer Representation Agreement (when proceeding) and any registration requirements with the builder. No guarantee is made regarding availability or dollar amount; ranges provided are illustrative.

6) No Agency Created by Use of Site

Using this site or communicating with us does not create an agency relationship. Agency requires a signed Buyer Representation Agreement. Until then, we may treat you as a customer rather than a client.

7) Intellectual Property

All content (text, logos, graphics, trademarks, videos) is owned by Save & Build™ or its licensors and protected by law. You may not copy, reproduce, or distribute without permission.

8) Acceptable Use

You agree not to misuse the Services (e.g., reverse engineering, scraping, introducing malware, infringing IP, or attempting unauthorized access).

9) Third-Party Services

We may link or connect to third-party tools (e.g., Caphub, Jotform, e-sign platforms). We’re not responsible for third-party content or policies. Your use of those tools is subject to their terms.

10) Disclaimer of Warranties

Services are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law.

11) Limitation of Liability

To the maximum extent permitted by law, Save & Build™ and its affiliates are not liable for indirect, incidental, special, or consequential damages. Direct damages, if any, are limited to the amount you paid to us for Services related to the claim (if applicable).

12) Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Services or violation of these Terms.

13) Changes to Services or Terms

We may modify the Services or these Terms at any time. Continued use after changes means you accept the revised Terms.

14) Governing Law & Disputes

These Terms are governed by Texas law. Venue for disputes is Collin County, Texas courts, unless otherwise required by law.
