Terms of Service
Effective Date: 07/2025

1. Overview

Save & Build™ is a virtual real estate funnel system designed for new construction buyers focused on DR Horton communities. Operated by Kristi Bell, REALTOR® with Fathom Realty, this system offers qualified buyers a 2.5% Buyer Credit at Closing when represented virtually.

2. Representation & Brokerage Compliance

All services are provided under Fathom Realty in compliance with TREC (Texas Real Estate Commission) regulations.

Required consumer notices, legal footers, and disclosures are included in all emails, forms, and digital communications.

All clients must be registered with the builder before executing a contract for credit eligibility.

3. Buyer Credit at Closing

Eligible buyers will receive up to 2.5% of the final home price as a Buyer Credit at Closing.

This credit is subject to the builder paying a full 3% buyer's agent commission.

The Buyer Credit is not guaranteed and will be adjusted or voided if:

Buyer registers with the builder without Kristi Bell listed as their agent.

Buyer signs a contract before agent registration.

Builder refuses to pay full commission.

4. Virtual Service Model

Kristi Bell provides fully virtual real estate representation. In-person services (home showings, tours, walk-throughs, closings) are not included.

All consultations are conducted via phone, video call (Zoom), or digital platforms.

Lead follow-up, form submissions, and scheduling are managed through Captivation Hub and/or Jotform.

5. Use of Personal Information

Your information is collected for the sole purpose of providing real estate representation.

Data is stored securely within CRM and automation systems (e.g., Caphub).

Your information will never be sold or shared outside of necessary transaction partners.

6. Limitation of Liability

Save & Build™ and Kristi Bell do not control builder pricing, incentives, financing, or home availability.

All information presented is believed accurate but subject to change.

Buyer assumes responsibility for verifying financing eligibility and final costs.

7. Loyalty & Referral Program

Buyers may opt in to receive post-close gifts, referral bonuses, or anniversary emails.

Participation in feedback surveys or testimonials is voluntary and not tied to the Buyer Credit.

8. Amendments

These terms may be updated periodically. Continued use of the Save & Build™ Funnel signifies acceptance of current terms.
